Gay / Lesbian Community Info



In the late 1970's Philip was the first New York City real estate broker to advertise in the Advocate, the nationally known and respected gay bi weekly magazine. As a result of that ad, Philip has been serving and selling to gay, lesbian, bisexual and transgender individuals and couples relocating to New York City from other parts of the country and overseas ever since.

The main issue that repeatedly came up in these transactions is how a same sex couple can successfully buy a cooperative apartment in New York. Coop apartments are virtually unknown throughout the rest of the United States but in the 1970's coops were the only available apartments one could buy in the City (with one or two rare exceptions of condominiums).

What is unique when a couple is buying a cooperative apartment is the way that the couple takes title to the apartment and presents their application to purchase to a coop Board. The coop Board's review of this application determines whether the applicants fall within the financial guidelines the board has set and whether the buyer is financially qualified to purchase the apartment.

Coop boards pretty much take the position that a married couple's combined assets and incomes are considered together. An unmarried couple (be they heterosexual or homosexual) is not treated the same way. The rationale for this is that if the relationship ends, each one of the applicants must be able to afford to carry the apartment on his or her own. This is obviously outdated based on the prevalence of heterosexual divorce, but this has always been the way it is.

The issue also arises if one of the couple makes the majority of the income and has most of the assets. How is the other member of the couple dealt with in structuring the purchase? Philip has been able to come up with creative solutions to deal with these issues and therefore has consummated many transactions in coops (as well as condos) with same sex partners. If and when same sex marriage is recognized in New York State, this will no longer be an issue, but in the meantime, Philip's 30 years experience in the business will come in handy in getting you and your partner settled into the apartment you want.

When Philip entered the business in 1978, there were virtually no male brokers working in residential real estate in Manhattan. The few that existed were mostly gay men. Today in 2007, the percentage of residential brokers that are gay men is even smaller than before.
